You can write a statement in any form. But there are mandatory points that need to be specified:

- It is necessary to address the claim to the director of the store in which the defective goods were purchased. Ideally, this is the name and initials, but if you do not know the data of the head, then you should write: "To the store director (store manager) ....". At the ellipsis place the name of the shopping facility.

- In the upper right corner of the application, indicate your surname with initials, address of residence and phone number.

- Next, describe your problem. Indicate everything briefly: on what date, in which place the product was purchased, product quality, defects detected.

Based on the 18th article of the Law "On Protection of Consumer Rights" you have the right:

- request a replacement for a similar product (of the same brand);

- ask for a replacement for the same product of another brand;

- Demand to reduce the price in proportion to the defect;

- demand a full refund.

Having described the situation, you should choose one of the above items, indicating it in a statement, with reference to article 18 of the Law "On Protection of Consumer Rights". Then write that if you do not meet your requirements, you will file a lawsuit.

The application is ready, now you need to make a copy of it, as well as copies of checks of the guarantee document. One package of documents (claim, copies of a check and a guarantee document) is given to the manager / director or seller. An important point: the store employee must leave his signature, seal and number in two copies.

For certain groups of goods, the terms of consideration vary from 3 to 20 days. The store can make an independent examination, as a result of which a decision will be made. It happens that the seller refuses to even accept the claim. In this case, send a letter (along with all copies) with a notification to the store address. The date of application will be the day the letter is received.

Note

- If the store continues to ignore your claim, contact the consumer protection committee.

- If you want the purchased goods to be repaired, the seller must provide you with a replacement for temporary use.

According to the list of RF PP 55, dated 01.19.1998, there are goods whose replacement for the time of repair is not provided:

- motorcycle and car equipment, wheelchairs;

- electrical appliances, medical devices and devices used by hairdressers, as well as items intended for heat treatment;

- weapons.
