Creating a family, everyone thinks that he will live a long and happy life with his chosen one. But only then, after some time, it becomes clear that there is no way to avoid a divorce. I think it makes no sense to list possible reasons. Everyone already knows everything about them. I would like to touch on a slightly different topic related to the process of divorce. We are all educated people, but not everyone knows what they will face and what to go through.
Divorce is not the easiest thing, and not even because it is very difficult to endure morally, but also because it will have to be tackled before handing out a certificate. And yet, if you know all the nuances, then you can get a divorce without problems. It is most advisable to read the family code before filing the application, which describes all the rules of the divorce process. In this article, we will touch on only some aspects that are worth paying attention to, and without which there is simply no way.
Today, two state bodies can divorce spouses: the registry office and the court. Divorce through the registry office is the simplest and fastest, but it is carried out only if both spouses are ready to divorce, while they do not have common minor children. Everything seems to be clear here, but pay attention to the following: common children are understood not only as your consanguineous, but also those who were adopted in the process of family life. If you have such children, then the registry office will refuse to divorce you. But if you have children from a previous marriage, the registry office does not have the right to refuse you.
Now about the documents. Your claim for divorce will not be accepted if you do not attach a birth certificate, an identity document and a receipt for payment of state duty to it.
Pay attention to one more thing: the registry office can only breed you, but it will not be able to solve problems such as, for example, the section of jointly acquired property. No matter how you would like to deal with everything faster, you cannot do without court in such situations.
Your divorce claim will be reviewed within one month. As a rule, the registry office does not appoint additional time for reconciliation, and the decision can be postponed only under one condition: both spouses will ask for it, since it is impossible to appear on the appointed day.
Now let's talk about what constitutes divorce through court. You will have to apply for divorce to this body if one of the spouses refuses to divorce, and also when the spouses have common children. Please note: no matter how your second half evades the divorce proceedings, you will still be divorced, however, only at the third meeting. Of course, you can calmly talk about this only if you have no children. But if there is a child up to a year, then without the consent of the mother, the spouses will not be divorced.
Simultaneously with filing an application for divorce, make (if necessary) a statement of claim for the division of property and the payment of alimony for children. If you do not do it now, but put it off for later, a lot of time will be lost, and your divorce will be delayed for a few more months.
From the documents to the court you must provide: a statement of divorce, a passport (or other identity document), a birth certificate for each child, a receipt for payment of state duty. If it is impossible to independently solve the problem of the division of property, a lawsuit is filed for its division in a judicial proceeding. Also, if necessary, we attach an application for the payment of alimony.
You will be called back to court exactly one month later. Both spouses must be present, otherwise the divorce will be postponed until the next meeting. Note that you should not rely on a quick divorce, since the court reserves the right to allocate time for reconciliation to the spouses, or, due to any circumstances, refuse to satisfy the claim. A little tip: explain in detail the reason for your desire to get a divorce. The more you argue that your family cannot exist, the faster the divorce process can end.
