A feature of compulsory liability insurance is that CTP does not insure the car, but the liability of its owner to third parties. That is, the policy will compensate the harm caused to other participants in the movement. The cost of repairing a car in an accident is not compensated for by this type of insurance.
Only the injured party will receive money from the insurance, and not the culprit of the accident. The only exception when, as a result of an accident, he can receive payments under compulsory motor liability insurance, is mutual fault.
On April 19, 2013, the State Duma adopted a bill according to which payments under compulsory motor liability insurance will increase. The increase in insurance amounts will occur in stages from 160 to 500 thousand rubles per victim. Also, payments for compensation for damage to property will increase from 120 to 400 thousand rubles. Victims will have the right to choose whether to receive compensation in money or to be repaired at the service station.
It must be understood that in order to quickly and surely receive CTP payments from the insurance company, you need to start acting immediately after the accident. First of all, it is required to properly execute the accident, correctly write a statement, collect all the certificates and successfully pass the examination.
The more serious the accident, the more time all these procedures will take. Any error in the paperwork may become a reason for refusal of compensation.
In the event of a serious accident, it is important to immediately find witnesses to the accident. Call the traffic police immediately. Before their arrival, inspect the car yourself to know what damage should be described in the documents. If some of them are not reflected, CTP payments in your favor will be lower.
While waiting for the crew to call, call your insurance company. Explain the situation to the operator and follow his recommendations. You also need to fill out a document with the second participant entitled “Traffic Accident Notice”. Do not forget to affix signatures (yours and the second participant) on all copies.
On the day of the accident you need to get a certificate of form No. 748 (on participation in an accident). If a protocol on an administrative offense was drawn up, it is necessary to take a copy for submission to the insurer (certify all documents with seals).
In the end, you should set a date for the visit to the investigator, who will determine the culprit of the accident. You will be issued an offense order. Do not forget about the terms of payment for CTP. Within 15 days after the incident, you will need to visit the payment center of the insurance company, draw up an application and leave a full package of documents (certificate No. 748, protocol of offense, Title, inspection certificate, registration certificate and vehicle owner’s passport, driver’s license, bank details for receiving compensation). Payments must be made by insurance within 30 days after receipt of the documents (or you will be sent a reasoned refusal).
According to the law, OSAGO payments are always made taking into account depreciation. This means that the older the car, the lower the damage will be assessed. That is, the amount indicated in the examination is likely to be greater than the amount that you can actually get from the insurance organization.
