According to Art. 13 of the law that regulates labor protection, a labor protection commission should be formed at each enterprise, the number of employees of which exceeds 10 people. Let us further consider what activity it carries out.
General information
The provision on the labor protection commission is also provided for in art. 218 TC. The committee can be created at the initiative of employees or the employer. A representative body of workers may also propose the formation of such a structure. The composition of the labor protection commission should therefore include representatives of:
- The employer.
- Labor union of workers (or other body authorized by employees).
The formation of committees is carried out on a parity basis. The Model Regulation "On the Commission on Labor Protection" must be approved by the federal executive body. Committees are created in organizations, institutions, enterprises regardless of the type of property, the scope of production and economic activities and departmental subordination.
Purpose of creation
One of the main responsibilities of the employer is labor protection. The labor protection commission is intended to carry out joint actions by the head and employees of his enterprise to ensure that OSH requirements are established by law. The main purpose of the formation of the committee is the prevention of injuries at work and the occurrence of occupational diseases. This body provides verification of working conditions, evaluates how labor protection is carried out at the enterprise. The labor protection commission informs employees about the results of its activities, collects proposals on the section of the collective agreement on occupational health and safety.
Committee size
The labor protection commission in an organization, as a rule, includes trusted (authorized) persons from the collective itself or the trade union. The size of the committee is set depending on the number of employees in the enterprise, the structure and specifics of production, other factors directly related to the activities of the company, as well as by mutual agreement of participants representing the interests of the employer and employees. After coordination of all issues, the head approves the order on the labor protection commission.
Formation Features
The terms of creation, the duration of the authority, the work of the commission are stipulated by a collective agreement. These points may also be approved by any other joint decision of the employer and authorized representative bodies of workers. The election of proxies from employees is carried out at a general meeting of the team. Representatives of the employer are appointed by the relevant order of the head of the enterprise. The commission may choose from among the chairman and alternates of each party. In addition, the committee has the right to elect a secretary. At the same time, it is not recommended to appoint an employee as the chairman whose job responsibilities include checking the state of labor protection or who directly reports to the employer.
Meetings
At least once a year, the final meeting of the labor protection commission should be held. At it, representatives of employees, trade unions or other authorized structures from the personnel report on the results of their activities. The meeting may withdraw these persons from the committee if the unsatisfactory measures taken are recognized. Instead, these representatives are elected new. The activities of the committee are carried out according to plan. It is also adopted at the meeting and approved by the chairman. Current meetings are convened as necessary, but at least once a quarter.
The specifics of the committee
It includes interaction with government bodies that provide oversight of how labor protection is observed at the enterprise. The labor protection commission carries out activities in conjunction with the OT service of the company itself, as well as with specialists who are contracted. Moreover, in the latter case, the industry specificity and the specifics of production are taken into account, the specific interests of the team are taken into account. The work and payment for the activities of attracted specialists is established by collective agreement or other joint decision of authorized employees and the employer.
Tasks
To fulfill the duties assigned to the committee, it is advisable to undergo appropriate training in the courses. Their visit should be provided at the expense of the employer. The committee’s activity involves the development of a program of joint measures based on proposals from the parties to improve working conditions and its protection, to prevent injuries and occupational diseases in the workplace. The Committee also considers projects of sanitary-improving and organizational-technical measures for the preparation of the corresponding section of the agreement on occupational health or a collective agreement. The Commission for testing knowledge on labor protection analyzes the existing conditions at the enterprise. Based on the results of the assessment, the committee prepares the relevant proposals within the framework of the powers entrusted to it in solving the existing problems. The commission's tasks also include informing personnel about the condition of health at the places of their professional activity, the likely risks of health damage. The committee also clarifies to the collective their rights to receive individual remedies, compensation and benefits.
Credentials
To solve the tasks set, the commission carries out:
- Consideration of proposals received from the employer, trade union or other body authorized by the employees or individual employees regarding the creation of safe and healthy conditions for professional activities at the enterprise.
- Development of recommendations that meet the established requirements for the preservation of the life and health of staff during their employment.
- Participation in the inspection of places of professional activity at the request of employees.
- Consideration of the results of a survey of the state of conditions and environmental conditions in shops, production sites and in the whole enterprise.
- Development of recommendations, if necessary, aimed at eliminating the identified violations.
- Investigation of the causes of injuries and occupational diseases in the workplace.
- Analysis of the measures taken according to the working conditions and OT.
- Preparation of information and analytical materials regarding the actual level of industrial safety.
- Assessment of the process and results of certification of places of professional activity.
- Preparation of departments and the entire enterprise for mandatory certification for compliance with the requirements of the work sites at production facilities.
- Participation in the development of the budget project of the labor protection fund.
- Assistance to the employer in the implementation of advanced technologies, mechanization and automation of processes, new equipment for the formation of safe and healthy conditions, elimination of heavy physical activity.
- Study of the condition and operation of sanitary facilities and hygiene devices.
- Providing workers with overalls and other protective equipment, informing about the procedure for their use, providing therapeutic and preventive nutrition.
- OT propaganda, increasing the responsibility of employees to comply with safety requirements.
Committee Rights
In carrying out its tasks, the commission may:
- Receive from the head of the enterprise and service FROM information about the state of the conditions at the places of professional activity of personnel, information on occupational morbidity and the frequency of traumatic situations at work, the presence of harmful and dangerous factors.
- To listen at meetings of messages from the employer and his representatives regarding issues of fulfilling their obligations to ensure safety at the enterprise and observing the guarantees of the rights of employees to OT.
- Participate in the activities to formulate the measures provided for in the collective agreement or the corresponding agreement on issues within the competence of the committee.
- To make proposals to the head of the enterprise on imposing disciplinary sanctions on employees that violate the requirements of norms, instructions and rules on labor protection.
- Submit appeals to the relevant supervisory structures on holding authorized officials accountable for non-compliance with legislative and other regulatory acts in the field of occupational health, and concealing information about accidents and occupational diseases that have occurred in the workplace.
Conclusion
Responsibility for the formation of the commission lies with the head of the enterprise. At the same time, the legislation allows that the formation of a committee may be initiated by employees. This body solves the most important tasks in production. Including representatives of both the employer and employees of the enterprise, he provides a comprehensive study of issues related to the safety of the manufacturing sector. At the same time, the commission’s powers include not only a survey of jobs, but also the development of recommendations to improve the conditions in which professional activities of personnel take place. Equally important is the verification of compliance with the requirements of the TC by the enterprise management. In case of violations by both the employer and employees, the committee has the right to apply to the relevant authorities to bring the perpetrators to justice.
