The possibility of overtaking, as well as its types are regulated in Government Decision No. 1090. The law also defines the features of double overtaking, the rules and the possibility of this maneuver in specific situations.
What is double overtaking?
According to the current legislation, double overtaking is a type of advancing a vehicle in front of a particular car, which is accompanied by a race into the oncoming lane. After overtaking, the driver immediately returns to the lane intended for a particular side by road markings. It is possible to overtake not only one, but also several cars if they drive in the same lane.
Important regulations, as well as cases in which it is impossible to overtake, are indicated in paragraph 11 of the document. Such a definition as double overtaking is not established in these rules, but there are actions that fit this concept.
When talking about double overtaking, one of the following situations is usually mentioned:
- Overtaking a car that began to perform the same maneuver.
- An attempt to overtake cars that are behind a car that overtakes.
Having studied in detail the rules regarding double overtaking in traffic rules, you can find out when it can be implemented, and in which cases it is unacceptable and punishable by legal sanctions.
Double Overtaking Rules
In order to avoid sanctions, it is necessary to comply with certain rules when performing this action. The steps that the driver must take consistently:
- Activate the turn signal.
- Move to the lane where cars are moving in the opposite direction.
- Drive around the car in front.
- Return to the lane in which the car should go.
Deciding on double overtaking is possible only if the driver is convinced that there is good visibility around, there are no circumstances that could interfere with each step and lead to a violation of traffic rules.
How to overtake is prohibited?
Sometimes the situation on the road develops in such a way that the driver does not have the ability and the right to double overtake. The exact list of such provisions is regulated by Article 11.2 of the Rules of the Road:
- The driver noticed that the car in front began to overtake another car, and the size and type of vehicle in this case are not important.
- A road blocking machine has just given a turn signal or other maneuver.
- The car that was driving in the rear has just begun to overtake you.
- After the maneuver, there is no way or place to quickly return to your lane, there is a high risk of creating interference with the general flow of cars.
Where can not be performed?
Considering the provision of Article 11.4, it is necessary to abandon double overtaking in the following areas:
- Railways in the permitted crossing area, as well as the distance to and after them, are approximately 100 meters. This rule is valid due to the fact that in the place of movement of trains there is an increased danger for other vehicles.
- At intersections where there is a road marking, traffic light or other traffic control methods are used that allow vehicles to simultaneously move in opposite directions.
- At intersections that are not regulated, as well as on minor roads, when moving along which the driver must cede the right of preemptive movement to cars on the main road.
- On bridges, as well as other limited surfaces, in tunnels.
- At pedestrian crossings, because reduced visibility can not only lead to a collision with another vehicle, but also endanger the life and health of a person.
- In the place where the sign "Overtaking is prohibited."
- In areas that objectively seem dangerous, as well as in places where visibility is insufficient.
Overtaking through a double solid line is also prohibited.
Where can I overtake?
Sometimes the question arises for drivers: is double overtaking allowed in a particular place. Earlier in the Rules of the road, it was clearly indicated that it can only be carried out with respect to one vehicle. If there are several of them in front of the motorist, I had to abandon this venture. At the moment, the ban has been canceled, while many motorists continue to believe that overtaking several vehicles is also called double.
The possibility of double overtaking on traffic rules is present here, since the driver complies with all the prescribed rules. There are no additional obstacles on the road, the visibility range is optimal, and maneuver is carried out in an area not prohibited by the rules.
Advance: what is it and how is it different from overtaking?
It must be remembered that overtaking is different from advancing. If in order to overtake the next car ahead, there is no need to go on the oncoming traffic line, such a maneuver is considered not overtaking, but ahead. There are no and there were no clear restrictions for its implementation. It is enough that the driver is convinced in advance that there will be no obstacles in his way. There is no way to get ahead of a pedestrian crossing if another driver slows down or stops.
Unlike overtaking, you can start the lead in such situations:
- If you have to move in two lanes.
- Following another car that started ahead of time earlier.
When can they charge a fine?
Violation of the rules of the road can cause an emergency or accident. If the driver does not comply with the current legislation when making double overtaking, a fine may be sanctioned. There is also a risk of losing rights for several months.
Violation is detected by traffic police inspectors. The following methods are used for this:
- Tracking the carriageway at special points or on any section of the road.
- Video recording of violations by tracking systems installed along the roads.
Double Overtaking: Punishment
Depending on the nature of the violation, a number of preventive measures may be applied to the driver when making double overtaking not according to the rules or in the wrong place:
- Situations when double overtaking was carried out by a driver traveling on a secondary road with respect to a vehicle located on the main one, a fine of 1,000 rubles is applied.
- The absence of a signal when leaving to maneuver is punishable by a fine of 500 rubles. A warning will also be issued to the driver.
- In case of arrival at a lane or tram, railway tracks in a place where such an action is prohibited, for double overtaking a fine for traffic rules will amount to 5000 rubles. Deprivation of rights for up to six months will also occur.
- In case of repeated violation of the previous paragraph, the rights will be taken for 1 year already. If this violation is detected by video cameras, then the driver’s rights will not be deprived, but a fine of 5,000 rubles will follow. Such a replacement is made because it is impossible to accurately determine the identity of the motorist who was driving at a particular moment by the cameras.
- Performing double overtaking in a place where a sign prohibiting this action is installed will entail the issuance of a warning and a monetary sanction in the amount of 500 rubles.
Features
The concept of "double overtaking" in the SDA includes an attempt to get ahead of a car that earlier itself began to perform this action. Since overtaking requires moving to the oncoming lane, such an act not only violates the rules of the road, but is also dangerous for the life and health of the driver. In most cases, the width of the roads is limited to one lane in each direction. Three cars cannot fit into this distance, and there is a danger of failing to warm up with a car moving in the oncoming lane.
The specified type of double overtaking by traffic rules is prohibited. It is impossible to begin its fulfillment not only if the vehicle in front has begun to overtake another, but also when it passes an obstacle. Punishment is provided for in Article 12.15.4 of the Code of Administrative Offenses. A fine of 5000 rubles is charged to the driver, and deprivation of rights for a period of 4 months is also carried out.
In most cases, drivers do not risk double overtaking when another driver has already started the event, but sometimes an emergency situation is created by accident. For example, when one driver decides to overtake the car in a place where double overtaking is allowed, and another one leaves in front of him. In such a situation, the one who started the maneuver first does not call back, but moves to the left and increases speed. In such a situation, the offender is the one who began to overtake the second, as his actions contradict section 11.2 of the SDA on double overtaking. Such an act will entail a fine and deprivation of rights only for the specified offender. Another driver overtaking will remain innocent.
If you decide to double overtake, you first need to pay attention to the situation on the road, determine the approximate speed of vehicles moving nearby, make sure that there are no obstacles at a short distance, so that the maneuver does not lead to an emergency. In case of violation of traffic rules there is a risk of getting into an emergency situation, in which the punishment for the culprit is not limited to a fine.
