The length of service for a sick leave, and more specifically, filling out a line on length of service, was recently commented in one of the branches of the Social Insurance Fund of the Russian Federation. The officials decided to recall how employers should fill out a length of service in the certificate of incapacity for work.
So, the insurance record for the sick leave is indicated in the line with the corresponding name. In the cells “years” and “months” it is worth entering the number of full years and months of work that are recorded in the employee's insurance record. The line “non-insurance periods” shall take into account the period of completion of military or other services by an employee. The length of service for sick leave must reflect the total number of years and months worked under an employment contract. Also during this period it is necessary to include the time spent in service in law enforcement agencies, military and fire services.
What is included in the length of service?
The insurance period includes the period of work under an employment contract, the period of civil, municipal or public service, as well as the period of activity in which the employee was subject to compulsory social insurance in case of illness and in connection with pregnancy and motherhood. These periods are indicated in the "Rules of confirmation and calculation of insurance period". These periods include those during which a private notary, individual entrepreneur, lawyer, security guard, etc. voluntarily paid insurance contributions to the FSS.
It should be remembered that the insurance period does not include certain periods that were previously taken into account. This is the time of service in the army, training in vocational schools, etc. The insurance period is calculated according to the entries in the work book. As for activities that are not listed in the work book, for its inclusion in the insurance period it is necessary to provide special documents to the accounting department, the name of which you will specify there.
In order to calculate the length of service for sick leave, you need a work book and a calculator.
To calculate the average earnings, the entire amount accrued for a given settlement period must be divided by 730. The amount of earnings includes all types of remuneration and payments to the insured person. The amount received may not be more than the established amount for assessing contributions. The limit amount is changed annually, new information can be checked with the employer or in the accounting department of your organization.
If the employee’s insurance experience is less than six months, the sick leave is calculated based on the minimum wage. The minimum wage changes very often, so it’s worth checking the amount in bookkeeping.
If your insurance experience is less than 5 years, claim a payment of 60% on average daily earnings. If the total insurance period is 5-8 years - payment should be made in the amount of 80% of the required amount. With insurance experience, the size of which is more than 8 years, you can get 100% payment of average daily earnings. Do not forget that full payment of the average daily earnings is also received by pregnant women, even if their experience at this place of work is less than six months. The same exception applies to workers who are injured in the workplace. In these two cases, the length of service for the sick leave does not matter.
If the sick leave was issued within a month after the dismissal, you have the right to receive material benefits from the former employer. The reason for the dismissal, as well as the duration of the disease in this case do not matter. And if in this case the labor contract was concluded more than six months ago, you can get a payment, the amount of which will be 60% of the average earnings. If an employee has worked in the company for less than six months, then he can expect to be paid in the amount of one minimum unit of remuneration.
Remember that material benefits are only granted when an employee is sick, and not his child or another family member.
