What determines the responsibilities of the bailiff?

The duties of the bailiff are established by the job description at the duty station, however, it should be based on the legislation of the Russian Federation, primarily federal law number 118, adopted in 1997, on July 21 (“On Bailiffs”). It is immediately worth noting here that the regulatory act distinguishes two types of bailiffs: employees who provide for the operation of courts and bailiffs.

The duties of the bailiff (performer) include the passage of special training, as well as state fingerprint registration. Employees of this department are required to wear uniforms and decals, have appropriate certificates, and in some cases, weapons. According to article 8 of the above law, certain ranks after training can carry, store firearms, which have certain limits of application.

The duties of the bailiff are set out in article 12 of the normative act “On Bailiffs”. In accordance with this section of the document, the bailiff must work in such a way as to ensure the execution of the decisions and documents entrusted to him. His competence includes providing the parties (in executive proceedings) with documents for familiarization, receiving personal data of persons and processing them, announcing and conducting the search for persons, obtaining documents and certificates.

In addition, the duties of the bailiff (executor) presuppose the right to inspect employers if they have employees who must take any action on executive documents. They also have the right to visit, open premises or storage facilities (subject to availability of relevant resolutions), the right to seize property and other values of the debtor, including money held in accounts with credit institutions.

The bailiff must be an impartial person, otherwise he must recuse himself. In accordance with it, it is the duty of the employee to warn the opposite side of the intention to use them, minimize damage and provide medical assistance to persons who have received damage.

Information cannot be disclosed

What functions does the bailiff still perform? Job responsibilities here also indicate that the employee should keep state secrets and not disclose information about the private life, dignity and honor of citizens about whom any data were obtained. The work of the bailiff is quite difficult, as it is necessary to find the persons indicated in the decisions, conduct explanatory talks with them about the fulfillment of obligations, and in some cases “take battle” with the premises, describe the property, which is unpleasant from a psychological point of view, and sometimes from the side of physical health. Salaries in this area vary depending on the level of subordination from 15 to 45 thousand rubles. Employees are paid travel, compensation for the use of personal vehicles.
