Years go by, the country is undergoing changes. If in the 90s the presence of shopping pavilions near public transport stops, metro stations and other crowded places was considered the norm (or even an integral part of cities and other settlements), now the authorities are very responsible for the destruction of such “monuments of hard times”. This cleansing whirlwind and the capital of Russia did not bypass. Demolition of self-construction in Moscow is gaining momentum, but the peripheral regions have not yet reached such a step. But, of course, there is hope that the whole country will be able to cleanse itself.
Where did the samostroy come from?
The last decade of the last century had a lot of unpleasant moments. There was arbitrariness in the country, there was a terrible shortage of products, and all people survived as best they could. Hence the attempts to develop a business in order to have at least some income (you need to feed your family). It is for this reason that such a concept appeared - self-construction.
Tents and trade pavilions appeared everywhere. Even if at the present time you visit several small towns on the periphery, you can fully plunge into the atmosphere of the “dashing 90s”. Indeed, the demolition of self-construction in Moscow even began relatively recently, and it may not even reach the settlements in the wilderness.
Until some time, the presence of such tents did not surprise anyone. In them, people often, on the way to work or study, acquired relatively inexpensive, but not very high-quality household goods. It seemed that such outlets densely entered the life of any Russian citizen.
But checks conducted by the authorities showed that most of the pavilions were built illegally. The reasons for the demolition of buildings were:
- threat to the life and health of citizens;
- distortion of the architectural appearance of the whole city;
- violation of safety precautions for metro stations;
- an obstacle to the development of road transport infrastructure;
- obstacle to access to communications.
It is these factors that caused a further storm called "Demolition of the self-construction in Moscow."
Who is involved in the demolition of buildings?
After the authorities announced that it was necessary to save crowded places from illegal buildings, not all owners of outlets were quick to follow the order. Of course, there were decent citizens who voluntarily and independently demolished their own pavilions, but there were people who ignored the announcement.
And once the first list of demolition of an unauthorized building appeared in Moscow. That is, the owners were warned. They were even offered assistance in finding a new location for outlets with a more convenient location. Again, not many people agreed to this. But the authorities have already decided to take drastic measures.
The first demolition of self-construction in Moscow took place on the night of February 8 to 9 this year. 97 buildings out of 104 planned were removed. By March, the remaining seven were demolished by the authorities. For the most part, these changes caused extreme indignation in society. Over time, this wave subsided, and Muscovites began to notice with surprise how much cleaner and more picturesque their city could be.
Demolition Financing
To dismantle their tents, the owner can either contact the companies of this profile directly, or contact the local authorities and transfer the demolition to their care. In the first case, it should be noted that monetary compensation to the ex-owner will be calculated in terms of 55 thousand rubles per square meter. The second option is less profitable: here the payment will be 51 thousand rubles per square meter.
Thus, the authorities are trying to reassure citizens, to make them understand that their unauthorized construction (for demolition) in Moscow, although not needed, is demolished to create a more favorable environment. And trade itself is not prohibited, just others are given that are intended for this place.
There are some nuances. Given the cost of retail space in Moscow, for the money raised it will be very difficult to purchase a pavilion of equal value, since prices per square meter in some areas are no less than 120 thousand rubles. And this is the minimum value. Many experts in this field call at all sky-high sums - from 500 and above thousand rubles. In this case, the ex-owners of the trading pavilions will only have to rent a trading floor.
How much has already been done?
Almost a year has passed since the first dismantling of the buildings. During this time, 211 illegal structures were removed. And this is far from the end, the new list of demolition of self-building in Moscow involves the elimination of another 43 facilities.
According to several newspaper publications, more than 65% of owners voluntarily demolished their outlets. Considering the fact that a warning about dismantling was reported to all owners of the pavilions, it seems surprising that 35% of people disagree with the dismantling. Constitution and demolition: is everything really according to the law?
Formally, the documentation from the owners of outlets is all right. There are certificates of ownership and other related documents. Several people tried through the court to defend their right to preserve outlets. But, according to the Constitutional Court, these buildings cannot continue to exist in their former places, as this can damage the safety of citizens.
Moreover, in addition to warnings in the media, two months before the expected date of the liquidation of buildings, an information board is installed within the territory of the illegally constructed trading premises . And he, in turn, just can not go unnoticed.
Ex-owners of self-building: how to be?
If people met the first wave of demolitions extremely aggressively, then the liquidation of the second list of objects was of little interest to anyone. Even the former owners themselves did not come to see how they were destroying their property. Most of the citizens whose buildings were on the list, almost meekly agreed to the voluntary demolition of self-construction in Moscow.
As an example, LLC "Creation". A representative of this organization asked tenants to vacate the premises in advance. Communications were cut off a bit later, and by the time dismantling began, the building was prepared. Many people have acted in this way, realizing the futility of the struggle with power. The only thing that scares the volunteers is the insecurity of paying compensation.
Although there are those who are trying to defend the right to establish their prices. The owner of the buildings at the Kropotkinskaya metro station through the court is trying to achieve an increase in the amount of payments to 120-150 thousand rubles. He argues this by the inability to make the purchase of the same space for the amount of compensation.
Have volunteers been paid?
Yes, for those who did not try to resist the decision made by the authorities, money began to flow into the account from November 16. LLC Nature-Ilal received its compensation among the first. The building was 216 square meters in size and was located in the Northwest District.
Creating an application for compensation is a rather long and problematic process. To do this, you need to collect a package of documents, some of which are quite difficult to do. All these papers, together with a claim for damages, must be taken to the prefecture of your county. Over the next two months, payment must be made to the owner’s account.
We must not forget that the right to payments is available only to those citizens who, within the prescribed time period, have issued voluntary consent. Ignoring the announcement of the demolition, of course, no compensation is provided.
New worries. What awaits in 2017?
Next year, the population will face new demolitions of the self-building in Moscow. The list of buildings has already been compiled and approved by local authorities. In January 2017, forty-three illegal facilities will be destroyed. Their location is diverse, in each district there are several such buildings. Those whose outlets have come under liquidation should not worry about payments: compensation for former owners of self-construction is currently in full. The right to appeal to the prefecture with a request for help in dismantling the building remains.
