The new rules for the carriage of goods by many are interpreted as a kind of โsystemโ that opposes the existing chaos. The article highlights the main points of the new rules.
The rules for the carriage of goods by road consist of eight provisions, the first of which reveals their main essence. In addition, the general provisions indicate the points included in the rules, namely:
- the procedure for the transport of goods in international traffic;
- the procedure for the transportation of goods of the category "dangerous" within the intercity, suburban and city traffic;
- the procedure for the transportation of goods of the "perishable" category within intercity, suburban and city traffic, as well as international transport.
The general provisions also clarify the meaning of the accompanying sheet, package, consignment, heavy, bulky and divisible cargo.
The second provision contains information regarding the conclusion of freight (chartering) contracts for vehicles intended for freight services. This provision, included in the rules for the carriage of goods by road, determines the procedure for the submission of an application (order) to the carrier, the conditions for filling out a bill of lading, which is a confirmation of the conclusion of an agreement for freight carriage. In addition, the provision provides for the provision of information containing the conditions, cost and procedure for paying for freight services. Particular attention is paid to the transportation of valuable cargo and transportation with a person representing the interests of the cargo owner. In the absence of accounting for traffic, transportation is carried out provided in accordance with a charter contract or transport order.
The third provision clarifies the concept of providing containers and other vehicles, receiving for transportation of goods, as well as loading goods into containers and other vehicles. At the same time, the conditions and terms are explained, and the suitability indicators of the vehicle for transportation are also determined. Upon receipt of the cargo, the carrier has the right to make reservations and comments to the points of the bill of lading. All changes related to the conditions of carriage, including targeted changes, must also be made to the document. In some cases, the consignor has the right to refuse to fulfill the charter contract. Rules for the carriage of goods by road include the application of marking and handling inscriptions and signs appropriate to the load. The rules establish the procedure for loading cargo and the choice of means of securing it.
The fourth provision, included in the rules for the carriage of goods by road, clarifies the procedure for determining the cargo mass and sealing vehicles.
The fifth position highlights the delivery time and the procedure for the issue of goods, as well as the cleaning of used vehicles. In this case, the presence of a bill of lading is an essential condition.
The sixth position explains the features of the transportation of goods of a particular type, the definition and accounting of its mass. The rules for the transportation of food products (perishable goods) are subject to the mandatory conditions specified for each type. At the same time, its full safety must be ensured.
In conclusion, the seventh provision explains the procedure and conditions for the preparation of claims and execution of acts. In this case, the preparation of the above documentation is allowed without the participation of one of the parties with written notification. Notes on the preparation of claims or the execution of an act are made by authorized persons. The number of copies must be equal to the number of persons involved.
