In 2017, legislation regarding parking spaces was amended. Their essence is the introduction of the minimum and maximum size of a parking space for a car (passenger and not only). In addition, the courtyard parking lot has received the status of a property and now it is possible to acquire it as a property, like an apartment or a garage.
The size of the parking space in accordance with GOST
The main document reflecting the dimensions of parking spaces is SNiP 21-02-99, which began to operate in 2011. It limits the parking area under the car to 2.5 meters wide and 5.3 meters long. These dimensions do not include marking of parking spaces, the dimensions of which reach 0.1 m in width.
If the car belongs to a disabled person, parking parameters increase. The dimensions of the parking space in this case are up to 6.2 m in length and 3.6 m in width. Disabled places are allocated 10-20% of the total parking area near large shops, shopping centers, hospitals, cultural institutions, as well as parking lots in modern residential neighborhoods.
The same document regulates the totality of technical requirements related to the organization of parking space, as well as the parameters of those materials that are used to enclose the territory. The main ones are:
- Parking in any yard should always be fenced with side stone.
- Both in yards and other places, mandatory on vertical supports (poles, etc.), reflective markings should be created.
- The asphalt surface is marked with nitro paint or thermoplastic. In practice, in most cases, you can observe the use of an inexpensive water-based emulsion mixture. During the season, it is usually washed away by precipitation.
Effective since the beginning of 2017, legislative changes have determined the minimum parking space with dimensions of 5.3 x 2.5 m, while its maximum parameters are the same as for places for disabled people.
Important nuance
In addition, from January 1, 2017, the car place has been recognized as a property. It can be bought, taken in a mortgage at the same time as the apartment, bequeathed, sold and done with it all the same manipulations as with any property.
Carrying out marking work, preliminary preparatory procedures are carried out - site selection taking into account the standard size of the parking space and determining the total number of parking spaces and the features of their location. Most often we are talking about parking for cars - trucks are parked in special areas.
The possible gap between the borders is taken into account - which implies the possibility of free passage between the machines of one person. Pay attention, in addition, to the type of car parking - in width or in length. Secondary factors include the thickness of the markings, the type of fence and a number of aesthetic considerations.
It is advisable to apply the marking in warm, dry weather with an air temperature of 18 to 25 degrees Celsius. The materials recommended for this are paint, thermoplastic or polymer tape. The size of the parking space may deviate from the permissible no more than 5 cm.
Procedure for applying parking markings
- The material is getting ready for work.
- The place is being prepared - it is completely cleared of old markings, garbage and dust.
- A preliminary contour is applied according to the intended parameters.
- Each of the contours is painted over until a smooth line is obtained.
- Finalization is being carried out - areas for disabled people are marked, poles are painted with luminescent paint, if necessary, numbering or other means are applied for ease of navigation (in the case of an extensive parking zone).
Unauthorized parking in the yard
In almost any yard, one can observe the capture by citizens of a part of the courtyard parking space using various objects - boxes, poles, weights, concrete blocks, etc. Most often, such actions are illegal, since the land surrounding the apartment building is the property of the municipality or common shared ownership of tenants. In the event of a similar situation, it is possible to appeal against the illegal actions of a neighbor by filing a complaint with the Criminal Code, the city administration or a district police officer.
The statement may be supplemented by photo or video materials, testimonies and other evidence of an offense.
Legal registration of parking in the yard
Under the concept of parking spaces, the law means the part of the parking lot enclosed by special structures or markings with the obligatory reflection of this fact in cadastral registration. Thus, the parking place has an exclusively intended purpose (only for parking cars) and, like any real estate, is subject to state accounting.
Obtaining the right to exclusive use of this place is a rather laborious procedure. To implement it, you should take actions in this order:
- The owners of the house by the general meeting must decide on transferring part of the common adjoining territory to private ownership or on lease for the purpose of organizing a certain number of parking spaces.

- The protocol, signed by all consonants in the presence of a quorum (i.e., half or more of all owners), refers to the territorial office of the cadastral chamber with the aim of calling an engineer. Tom will have to carry out the necessary measuring work, the payment of which rests with the residents.
- Then the territory is put on cadastral registration, for which it will be necessary to provide a package of documents from the cadastral plan of the territory, the mentioned protocol, personal passport and certificate of ownership of the apartment.
- Having stocked up a certificate from the chamber and a project of the territory drawn up by the engineer, we turn to the local administration for approval.
- Having received permission, we coordinate work with Rospotrebnadzor.
- Having acquired all the necessary permissions, we proceed to practical work on the marking and construction of fences, funds for which are also allocated by residents.
In the absence of official registration of the local area in the ownership of residents, it is considered to be the property of the administration by default. Then, in order to achieve the plan, it will be necessary to draw up a land lease agreement with this body.
