Civil servant, his duties, certification

A public servant is an employee who is in the public service in a certain position. He performs the relevant duties according to the job description.

Responsibilities and Responsibilities of Civil Servants

The responsibilities of civil servants are numerous and determined by their position, but they can be attributed to four main groups - professional, general service, official and restrictions.

1. A civil servant must ensure the implementation of the norms of the Constitution, maintain the established constitutional system; conscientiously fulfill the duties defined by his job description; protect and respect the legitimate interests and rights of citizens; to comply with orders, orders and instructions of senior managers who do not contradict the laws.

2. There are certain job and professional responsibilities. A civil servant, in accordance with his official duties, must timely consider appeals of citizens, institutions, public associations and organizations, local authorities, as well as take appropriate decisions in the prescribed manner, which is provided for by regional and federal laws. The level of his qualifications should be maintained at the proper level in order to perform duties efficiently, comply with labor regulations and work with information for official use.

3. A civil servant should not divulge state secrets and information relating to the honor, dignity and personal life of citizens. This is a limitation, but also an obligation at the same time.

4. In accordance with the Constitution, certain categories of civil servants are charged with specific tasks for certain positions, which are determined by the relevant instructions. At the same time, civil servants fulfill the general civil duties stipulated by the Constitution (pay fees and taxes, protect state property and natural resources, perform military service, etc.).

The civil servant is fully responsible for his actions. He is obliged to comply with the orders of the respective leaders, which are given within the limits of their authority. At the same time, a civil servant is prohibited from executing an illegal order. If this happens, he must justify in writing the illegality of the received order, referring to the provisions of the law, and also receive written confirmation of the need to execute the order.

Certification of civil servants

A civil servant is attested to determine the suitability of the position he holds.

During it, his immediate superior provides feedback on the quality of his performance of official duties for a given period. A motivated recall is supplemented by information about the instructions executed by the civil servant and the prepared documents. Certification is carried out in three years once.

An extraordinary certification is sometimes carried out in cases where a decision is made to reduce the posts or changes relate to the conditions of wages in state bodies.

The civil servant is certified by a specially formed commission.

If failure to attend certification without valid reasons or refusal is recorded, he shall be held liable for violation of discipline.

The commission usually takes the following decisions:

  • corresponds to the employee of the post being replaced;
  • it is recommended to include him in the personnel reserve to fill a higher vacant position;
  • does not match the position that is being replaced.

A public servant may appeal the results of the certification.
