There are a lot of people who want to rent or rent housing today. Landlords who provide such premises for rent should be aware of some rules that must be followed in order to protect themselves from possible risks. How it usually happens
In most cases, owners of apartments or houses wishing to lease their premises do not bother with the preparation of any documents. Often, some of them do not even bother to draw up and sign a lease with tenants. These ill-conceived actions in the end can lead to very disastrous results. Even the so-called deposit received in advance, which guarantees the payment of rent and the safety of property, will not help here. In the event of a legal dispute, the judicial authorities will be on the side of the tenants, because there are no documents!
Inventory and contract
The inventory of the property upon delivery of the apartment (the sample is located below), as well as the contract itself, to which it is attached and considered to be its integral part, are necessary in order to protect the property of the landlord. When drawing up the contract, the lessee and the lessor establish the rules for using the apartment in it, list each other's responsibilities (for example, who should make repairs or who is responsible for paying utility bills). But, in addition to obligations, the rights of counterparties are also included in the contract. These include the right of the owner to an occasional visit to a residential building for inspection. The parties can set certain dates when the owner will check the housing. They may also provide for any other rights of both the lessor and the tenant.
Why do I need a contract
By concluding a lease agreement, the landlord will protect himself from possible subsequent risks associated with relations with the tenant. These risks can be expressed in non-payment of rent, in damage to property, in causing other damage. The contract will be the document to which the landlord will be able to refer in court, as the basis of his rights and obligations of the tenant. Moreover, in the case of a crime involving an apartment or a tenant, the contract will be evidence in the investigation of the criminal case.
What is the inventory for?
Of course, the lease agreement will be incomplete if it does not include an inventory of the property upon delivery of the apartment, a sample of the filling of which can be seen in the photographs. What does this document give? Firstly, it lists all things and other items that are in the apartment (house) at the time of its transfer to rent. This will protect the landlord from such a case when upon termination of the lease it turns out that there is not enough in the apartment, for example, a TV. Referring to the inventory of property when renting the apartment (see sample below), the landlord can prove the fact of the presence of this TV when receiving and transferring housing. That is, he will be able to convince the court that the tenant received an apartment with a TV, and returns it without him. Consequently, the amount of damage caused to the owner must be recovered from such a tenant. If you have a contract and inventory, the court will make a positive decision and will charge the cost of the TV from the tenant.

How to draw up a document
An example of a property inventory when renting an apartment (sample of this document) is shown in the photograph below. However, we list all the necessary details that this act should contain. First, the document should be entitled. You can choose any name: “Certificate of Property Listing”, “List of Property”, “Certificate of Acceptance and Transfer”, etc. After indicating the name, the place of compilation and the number should be written. Next, information about the parties is filled in, the data of both the lessor and his counterparty are indicated, after which a reference is made to the lease agreement. After all the above information is fixed, the parties must write that the landlord transfers along with the premises, and the tenant accepts the “next property”. After these words, a list is made of all the property remaining in the apartment. To complete the drafting of the document follows the signatures of the parties.
Nuances
Depending on what is being transferred, what remains in it, some difficulties may arise. For example, if an empty room is rented out, then the act of the inventory of the property upon delivery of the apartment (the sample of filling is presented above in the photo) will contain very little information. It will only need to indicate such items as water meters, plumbing items, as well as others available in the room. However, at present, people quite often rent an apartment completely ready for living, having everything you need (even forks and spoons). In such a situation, the inventory in question may stretch over several sheets. It is important in such cases not to neglect the rules, write and indicate each subject. Moreover, the condition of the transferred property can be recorded in a photo or video, later attached to the lease.
