Many citizens in their lives had to accidentally see how other people use drugs. As a rule, normal law-abiding citizens do not do such things, because they know how to organize their leisure, have a family and work. But people who have certain psychological problems sometimes just don’t know how to get rid of them in another way, and begin to use prohibited substances, trying to temporarily not think about what is happening around. It all starts with the desire to experience new sensations, but more often it leads to death. It is for this reason that people whose loved ones are addicted or prone to infrequent drug use are wondering if there is any punishment for this in Russian law? Read more about this in the article.
General
Many citizens of our state often wonder if there is criminal liability for drug use. Can a person get a term only because for the first time in his life he decided to try to smoke weed or use any medication without a doctor's prescription? It should immediately be said that at present in Russia people who use prohibited funds are not prosecuted. However, there is another punishment for this - administrative. Therefore, a person who has just begun to use drugs should be aware that he is breaking the law. Consequently, the addict may be punished by the Code of Administrative Offenses.
In addition
From the foregoing, it became clear that the offender for drug use will not be sent to prison and not sent to forced labor. The Code of Administrative Offenses has its own punishment for this, described in Articles 6.9, 20.20 and 20.22. Now you need to find out what they are talking about.
So, as a general rule, a person will be punished for using drugs as prescribed in article 6.9 of the Code of Administrative Offenses. The sanctions are as follows:
- a fine of four to five thousand;
- arrest for a period of up to 15 days (no one would like to spend so much time in the police detention center).
If a person used psychotropic substances in a public place without a specific doctor’s appointment, then he must be held accountable under article 20.20 of the Code of Administrative Offenses. The fine here can be from four to five thousand. As an alternative sanction, arrest is applied for a period of up to 15 days.
Minors
The worst thing happens when teenagers start using drugs. But why is this happening? It is possible that the teenager was simply offered to try prohibited means in order to experience a “real buzz”, he agreed, and then got involved and became addicted. This is really very dangerous. Moreover, most drugs (especially synthetic ones) strongly affect the human brain, and especially the child, so that all changes that occur in the human head become irreversible.
For this reason, for parents and other legal representatives of minors, the Code of Administrative Offenses sets a fine in the amount of 1,500 to 2,000 rubles in the event that a teenager is seen in the use of prohibited substances.
Grounds
How can you determine that a person is under the influence of any illegal drugs? This can only be determined by a doctor after an examination. Therefore, if a person is accused of using drugs, then in order to prove the opposite, you need to do an analysis in the office of a narcologist. So, for example, if a traffic police officer stopped a driver who has impaired coordination of movements, red eyes and slurred intermittent speech, then law enforcement officers have the right to detain and take them for a medical examination. If the latter refuses to be tested by a narcologist in his office and does not behave quite adequately, the police have the right to believe that the person is under the influence of prohibited substances. Consequently, law enforcement officers have the right to detain such a citizen.
In another state
In Russia, the number of people who suffer from alcoholism and drug addiction is increasing every year. However, the number of heroin users is now minimized. In Russia over the past few years, the number of deaths from synthetic drugs has increased. Most often, “salt”, spice “is consumed by young people under the age of thirty. In addition, statistics show that mainly teenagers suffer from the action of these substances.
In addition, recently the number of drug addicts in Ukraine has sharply increased. Nevertheless, there are not such serious mortality figures as in the USA. Drug use in America is not comparable in size to any state. There, addicts use heroin, despite the fact that their number is constantly growing. Congressional deputies even called it the "heroin plague." After all, alcohol and drugs in the United States are used by adolescents aged 12 to 17 years. Nevertheless, America is trying not to advertise such serious problems.
The trial
So, according to the law, only a judicial authority can punish a person who uses drugs. This will be a fine or arrest for up to fifteen days. As a rule, if a person has not previously been held accountable for such an act, then he or she is assigned a day or two in the temporary police detention center.
Moreover, the recognition of the guilty party as an offender is of great importance here. It also affects the severity of the punishment. Either a fine or a few days in captivity.
Under the law, pregnant women or those who have small children are not placed in the IVS of the police. They are only fined. Although four or five thousand is a considerable amount for many citizens.
According to the rules, a trial for drug use will be held the day after the detention of the offender. A ruling of a justice of the peace may be appealed within ten days.
How to recognize in a timely manner?
The desire to experience new sensations sometimes prompts young people to try some kind of drug. However, not everyone knows that smoking weed greatly affects the functioning of the brain. Determining that a person is under the influence of this prohibited substance is not so difficult. After all, the addict's eyes turn very red and an incomprehensible and prolonged laugh is observed, hallucinations sometimes appear.
After a person begins to constantly smoke anasha, his threshold of sensations decreases and he wants more. Thus, he is drawn in and tries new types of psychotropic substances, so they "sit down on the needle."
In addition, relatives cannot immediately recognize a drug addict in their loved one. After all, at first he very carefully hides that he takes psychotropic substances.
However, the following signs of drug use are highlighted:
- secrecy (a person begins to carefully hide everything that happens in his life, because he is afraid to admit that he has become addicted);
- redness of the white membrane of the eyes - typical when smoking weed;
- continuous laughter - the addict may begin to laugh and rejoice without reason, despite the fact that this will continue until the moment the action of the prohibited substance ends;
- a person tries to be at home as little as possible, at school or at work, he makes new friends and acquaintances who also take psychotropic drugs;
- the addict has ceased to be interested in what used to be meaningful, dear and beloved;
- in his things were found syringes, bottles for injections or pipettes, tablets of unknown origin.
Characteristic
Addiction is a disease that must be treated. However, no doctor can help a patient without his desire to recover. Therefore, close people should convince a person to start timely treatment. This is necessary in order not to lose a family and to save the addicted life.
Nevertheless, the use of drugs and alcohol is considered the norm for many adolescents who from an early age begin to lead an asocial lifestyle. Most of those citizens who smoke weed cannot even believe that they are addicted. Although, this is indeed so.
The consequences of drug use
It all starts with the fact that a person’s life is reduced to finding a prohibited substance and taking it to remove “breaking”. After this, the addict begins to have gradual problems with loved ones who want to cure him of drug addiction. There were also cases when relatives called the police themselves and asked to take the addict out of the house, because life next to such a person becomes simply unbearable.
However, there is currently no sanction for drug use in criminal law. An article for these actions is available only in the Code of Administrative Offenses. The only thing that law enforcement officers can do is to determine the addict by decision of the justice of the peace in the detention center for several days. It will also not be a way out of such a difficult situation.
When the addict is completely drawn into the life of the addict, he begins to think only about what he needs to get and use the prohibited substance. Thus, completely loses touch with reality.
In order to earn a dose, addicts themselves begin to trade in drugs and receive considerable prison sentences for this. Moreover, most addicts end up in places of isolation for the storage of prohibited substances. And so all the pleasures of the addicted person end.
