Features of continuing education in procurement
Further education of specialists is aimed at updating their theoretical knowledge and their practical skills. Its need is determined by increasing requirements for professional training of employees. In the Labor Code (article 196, part 4), the employer has an obligation to send specialists to continuing education courses. According to 44-FZ, when forming the commission of the customer, the preemptive right to include in it is used by persons who have undergone professional retraining. It can be carried out both with a separation from direct activity, and without it. In the latter case, specialists take distance learning courses. Retraining can also be carried out with a partial separation from the main activity and according to individual programs of additional education. The latter are developed taking into account the specifics of the professional activity of a particular employee.
Important point
Until January 1, 2017, an entity having a basic or additional vocational education in the relevant specialty may act as an employee of the contract service (manager). In other words, he must undergo special training. According to 44-FZ, the organization of further education of specialists, as well as the issuance of relevant documents on its passage, is under the supervision of supervisory state bodies. The supporting papers are a certificate or diploma.
Continuing education system
Training in 44-FZ is carried out as part of a unified state policy focused on the training of contract service specialists . In order to ensure the proper implementation of legislative requirements, the Ministry of Education and Science together with the Ministry of Economic Development submitted proposals on creating an effective system for training employees and their state certification. In a general letter from these ministries addressed to institutions conducting educational work on additional programs, Methodological recommendations were sent. They explained the system by which continuing education in 44-FZ should be carried out. The letter also noted that these Guidelines can be applied by customers when they purchase educational services.
The validity period of continuing education under 44-FZ
In accordance with the previous Government Decree No. 610 of June 26, 1995, retraining is carried out as necessary. However, at the same time, further training in 44-FZ should be carried out at least 1 time in 5 years during the entire professional activity of a specialist. For individual employees, the employer has the right to set other periods. Paragraph 2.8 of the Recommendations states that continuing education in 44- should be carried out as necessary. At the same time, it is advisable to carry out retraining at least 1 time in 3 years. This recommendation applies to all categories of specialists.
Additional programs
They are developed and approved by educational institutions independently. At the same time, legal requirements for the level of training of employees involved in the relevant field are taken into account. Further training in 44-FZ is recommended in full-time and part-time form. The implementation of the programs is focused on improving or obtaining a new competency necessary for the effective implementation of professional activities. The results of mastering the programs are determined by the final certification of specialists.
Duration of retraining
It should be said that the norms do not clearly establish how long the continuing education in 44-FZ should last. 120 hours is considered the optimal period, which is established by institutions conducting educational activities. To clarify this issue, you should refer to the Procedure for organizing and implementing retraining, approved by Order of the Ministry of Education and Science No. 499 of 07/01/2013. In paragraph 12, in particular, it is established that the minimum duration of courses should provide the possibility of obtaining the planned results declared in the program. At the same time, the duration of retraining should not be less than 16 hours. At the same time, in paragraph 2.3 of the Methodological Recommendations, there is an indication that the minimum duration of mastering the programs should be set at least 108 academic hours. The exception is cases where the training for 44-FZ is held by the heads of customer enterprises. For them, the duration of mastering programs can be reduced to 40 hours. It is recommended that final certification be provided in the form of testing (exam) or defense of the thesis. Requirements for its volume, content and structure are established by the institution conducting educational activities.
Retraining of civil servants
For a correct understanding of the duration of their professional development, one should turn to Federal Law No. 79. Article 62 (part five) establishes that retraining of civil servants is carried out as necessary. At the same time, it is recommended to send employees to institutions of additional education at least 1 p. / 3 g. Since the legislation does not establish a different frequency, when referring specialists engaged in procurement to meet municipal and state needs, training should be guided by the specified period. Government Decision No. 362 of May 6, 2008 approved state requirements for the retraining and training of civil servants. In them, in particular, it is noted that advanced training can be carried out for employees to study relevant changes in certain issues related to their professional activities. In this case, the development volume may be 18-72 ac. h. In paragraph 2 of the 17th paragraph of the Procedure, approved by Order No. 499, it is established that for any type of classroom study, the academic hour is 45 minutes. The classroom is the type of contact work of students with a teacher. It includes lectures and seminars, group consultations or individual training. It also includes certification tests (intermediate and final).

Development of terms of reference:
- The main shortcomings and errors. Detection of traps in terms of reference based on established practice.
- The specifics of countering over-shortened delivery times in the procurement documentation.
- Errors in the formation of contract services and commissions.
- The practice of detecting violations during the admission / non-admission of participants.
- Signs of blind procurement during the transition period of the formation of the contract system.
Other sections may be included in the program.

In the absence of federal state standards and regulatory requirements for additional vocational training programs for employees of contractual services of the organization, on the basis of which professional development is carried out under 44-FZ (in Moscow or another other city), they have the right to independently develop their content, setting a different duration for their development. However, institutions must take into account that, according to the adopted Methodological Recommendations, the optimal period for retraining is at least 108 hours, except for exceptions established by law. Specialists note that programs, the volume of which is 72 hours, are suitable for specialists of suppliers. For customer organizations, the duration of professional development should be at least 108 hours, and for managers at least 40 hours. At present, there is an intensive change in domestic legislation. Periodically, adjustments and additions are made to the existing norms, including those regulating the procurement sector to ensure municipal and state needs. In this regard, it is necessary to timely and qualitatively update the knowledge of specialists involved in this field. In accordance with this, it is recommended that staff development training be conducted at least 1 p. / 3 years. This will ensure the proper level of professionalism of contract service specialists .
