Freelance police officers. Instructions for organizing the activities of non-staff police officers

On April 2, 2014, the President approved Law No. 44. This normative act regulates the procedure and conditions for the participation of the population in ensuring public order. The law is focused on the formation of a clear mechanism for attracting citizens to law enforcement.

Relevance of the issue

Prior to the adoption of the law, this area was regulated mainly by regional regulatory acts. Moreover, in the country there were more than 45,000 public associations of law enforcement orientation, which included more than 450 thousand people. For example, in the Moscow city squad there are about 20,000 people. With their help, more than 60 thousand violations were stopped, and 313 people were detained on suspicion of criminal activity. The authors of the law hoped that its adoption would ensure the involvement of the maximum number of interested parties in law enforcement . The normative act defines not only the forms of participation of subjects in the protection of order. Its provisions govern issues relating to the social and legal protection of such citizens.

Forms of participation

Citizens can provide assistance to law enforcement agencies. In the framework of this activity, individuals have the right to report to the police all crimes and threats of their commission. At the invitation of the police officers, persons can directly participate in law enforcement activities. It is also about ensuring public safety during cultural and entertainment, sports and other events. Citizens can participate in the search for entities missing.

How to carry out a search, in what places - the persons involved themselves decide. The only requirement that the law establishes is that citizens should not, by their actions, create obstacles for law enforcement agencies to fulfill their functions. Along with this, it is incumbent upon persons to inform police officers about facts that became known to them during the search and were of importance for its continuation. With appropriate training, citizens should provide first aid to victims of accidents, poisoning, etc.

In addition, the legislation provides for the possibility of subjects to participate in the work of public associations of the corresponding (law enforcement) focus. The decision to form such groups is made at a general meeting (assembly). Public associations are formed at the place of residence, location of property, work / study without creating a legal entity. Citizens are obliged to inform the local government and the territorial division of the Ministry of Internal Affairs about their formation.

In addition to assisting law enforcement officials in policing, participating in the identification and suppression of criminal acts, citizens can carry out outreach. In particular, they have the right to engage in the dissemination of legal knowledge, explaining the norms and rules of conduct in public places. The participants and founders of public law enforcement associations may be entities that meet the requirements stipulated by regulatory enactments.

Organization of the activities of non-staff police officers

Persons may be involved in activities to assist law enforcement agencies on a voluntary, free, public basis. The procedure and principles for involving subjects are established by the Instruction for the organization of the activities of non-staff police officers. The normative basis of measures to attract the population are the Constitution, Federal Law No. 3, as well as other acts.

1. Prevention and suppression of crimes, administrative violations.
2. The search for the missing.
3. Ensuring order in public places.
4. Forensic science events.
5. Road safety.
6. Protection of the state, person and society from illegal encroachments.

Specificity

Before becoming a freelance police officer, you must undergo appropriate instruction and medical examination. When involving in law enforcement measures, restrictions regarding service in the police department are taken into account. Non-staff police officers do not have the status of officials. They perform tasks under the direct supervision of an employee assigned to them in the prescribed manner. The relevant document is issued to persons. A sample non-staff police officer certificate contains the name of the subject and indicates its status. It should be signed by the head of the unit and the official seal.

How to become a freelance police officer? To be involved in law enforcement, the entity must provide:

7. Data on bringing to administrative and criminal liability.

Face Selection Rules

The selection of candidates for non-staff police officers is made by the employees of the departments of the Central Department of the Ministry of Internal Affairs, territorial bodies, organizations formed to exercise powers and fulfill tasks assigned to law enforcement structures. Business and personal qualities of individuals are studied and tested. Its results are recorded in the report of the responsible employee. The document indicates the conclusion about the possibility / impossibility of enrolling the subject in non-staff police officers.

Approval of candidacy

The documents listed above are provided to the head of the internal affairs department, who has carried out the study and verification of information. The chief decides on the possibility of enrolling a person in non-staff police officers. Upon satisfaction of the application, materials are sent to the personnel department to prepare a draft of the relevant order. The order should indicate the employee who will coordinate the work of the non-staff member. Upon transfer, dismissal or other circumstances, the employee may be replaced by another person in charge.

Certificate

It is issued under signature after approval of the order of admission. Documents that serve as the basis for issuing a certificate are stored in accordance with the established rules. Registration of issued forms is carried out in the registration journal. Citizens executed by freelance police officers are required to ensure the safety of the documents provided to them. In case of damage to the form, expiration or when changing the personal data of a person, it must be replaced.

Relief

The powers of a non-staff police officer may terminate:

1. At the initiative of the subject on the basis of a statement.
2. When committing misconduct, defaming the dignity, honor of a non-staff member. He, including, will be deemed to be the use of the issued document for personal gain, non-fulfillment or improper fulfillment of instructions received from a responsible employee attached to it.
3. In the case of obtaining reliable information about:

• initiation of criminal proceedings against a person;
• bringing to administrative responsibility for the encroachment on the management order or security in society;
• the person’s exit from the citizenship of the Russian Federation, the acquisition / presence of citizenship of another country;
• Providing knowingly false data when enrolling in ATS.

The termination of powers is drawn up by an appropriate order of the head of the police department. The issued document is seized for subsequent destruction in the manner prescribed by the personnel department. The registration card for the retired employee must be kept for 3 years. At the end of this period, it is destroyed.

Responsibilities of a Responsible Employee

Non-staff police officers, whose work is organized by coordinating officials, are required to conscientiously fulfill orders received. Responsible employee at the same time:

1. Gives specific tasks, instructs the subject on how to accomplish them, provides control over execution.
2. Participates in training sessions on methods and forms of law enforcement and crime prevention.
3. Increases the legal literacy of the controlled person.
4. Disseminates the positive experience of non-staff employees, makes proposals to the ATS management on how to improve it.

Bans

The responsible employee is not entitled to:

1. To entrust the subject with independent performance of investigative, operational-search measures. Unauthorized participation of non-staff members in the specified activity is not allowed. The responsible employee cannot also instruct a person to independently fill out protocols on administrative violations, and to verify received applications and reports of crimes and misconduct.
2. Involve the subject in carrying out activities that are obviously associated with a risk to his health / life.
3. Provide non-staff member with materials that are classified as state secrets and other information with restricted access for review.

Efficiency mark

The performance of freelancers is analyzed at least once a year. The results of the study of effectiveness are documented. It is composed of an employee coordinating the activities of a freelancer attached to him. The responsible official is obliged to report to the head of the internal affairs department about the inspection. At the same time, the employee submits his findings on the advisability of continuing cooperation with the citizen. For the activity shown, increasing the prestige of law enforcement agencies can be encouraged. The expression of gratitude is made out by the relevant orders of the head of the unit.

Legal Opportunities

The rights of a freelance police officer are subject to a number of restrictions. When executing orders and assignments, persons cannot independently make decisions. Citizens have the right to take part in operational-search and investigative actions with the consent and under the guidance of responsible employees. At registration, the officials coordinating them are obliged to clarify the range of possibilities and rules of conduct.

The cooperation of the population with the police is of great practical importance. Persons attracted on a voluntary and gratuitous basis, provide significant assistance to ATS. According to statistics, the disclosure of crimes, the prevention of illegal acts more effectively with the participation of the population. Performance is determined by various factors. First of all, citizens acting as freelancers do not have, apart from a certificate, any signs indicating their connection with the police. This, in turn, allows one to infiltrate certain groups without suspicion, establish surveillance, obtain evidence of committed or impending crimes. Often, it is precisely the timely information transmitted from non-staff employees that allows us to identify the perpetrators as soon as possible, find out the important circumstances of the incident, and uncover related unlawful acts. The head of the internal affairs department may announce incentives to especially distinguished persons.
