In the system of social and interpersonal relationships, the so-called social norms play an important role . They are some rules governing the activities of organizations, the behavior of people in various life situations, their relationships. These social norms may be
traditions, rituals, customs, established taboos and so on. At the same time, several species are distinguished in this category at once, different in nature, method of support and support, and sources. So, for example, the rule of law in the system of social norms (in other words, legal provisions) is distinguished by the fact that the state itself serves as their source and guarantee of security. In addition, there
are moral standards (rules of conduct established in the group, the failure of which leads to condemnation from the rest of the individuals); norms of customs (prevailing in a specific social environment and, as a result of repeated repetition, which have become a precept for implementation); norms of public organizations (which are also rules of behavior, but binding only on members of the corresponding local group: pioneers, officers, and so on). Of course, all these categories have unique characteristics that are unique to them. However, we will focus on legal requirements. Actually, the
rule of law in the system of social norms can be distinguished
on the following grounds:
- As already mentioned, in the series of social prescriptions they are the only ones coming from the state.
- They form a single complex of legal provisions, requirements and punishments.
- Clear system. Different provisions should not contradict each other.
- They are a measure of free behavior and the will of the citizens of the respective country.
- The rules of law in the system of social norms are issued in a clear concrete form, which does not imply ambiguous interpretations.
- They have a clearly defined limit of their own action.
- Supported and protected by all the forces of the state.
- Necessarily are a form of consolidation and realization of the rights and obligations of subjects of interpersonal and social relations.
- They are always an imperative prescription of government structures and express their willful decisions.
- The rules of law in the system of social norms are the only regulator of social relations available to the state.
- They are certain rules of conduct, mandatory for all categories of the population. In addition, the penalty for non-compliance is prescribed regardless of property, official, social status.
- Have a general character. They regulate specific typical social relationships, but they are not personified.
Law in the system of social norms. Structural plan
The internal structure of this category of social rules of conduct involves the following elements:
- Hypothesis - indicates the life circumstances associated with the entry of the norm into its legal effect. Hypotheses are complex and simple. Such a gradation is based on the amount of its conditions. The form of expression of hypotheses suggests its casuistry or asbestosity.
- Disposition - one of the structural elements of legal norms, containing the very prescriptions of the behavior of subjects in various kinds of social relations and indicating the essence of the content of law, as well as the obligations of the subjects. Actually, this is the main element of this system. Dispositions are divided into some varieties. For example, depending on their nature, they may be binding, authorizing and prohibiting. By the way they are expressed, they are relative and absolute.
- Sanction - determines the nature and measure of punishment applicable to participants in interpersonal and social relations who deny the role of law in the system of social norms and violate it. Sanctions also take various forms, depending on the degree of certainty: relatively specific, alternative, absolutely certain.
