A sick child should be at home and treated. But minors cannot be at home alone; they must be treated by an adult. The law allows parents to go on sick leave, but some prefer to send grandmothers to stay at home with their daughter or son.

What is required by law?

The legislation of the Russian Federation allows you to leave work to take care of a sick mother, father, guardians or other relatives of the baby.

The order of the Ministry of Health and Social Development of the Russian Federation N 624n “On approval of the Procedure for issuing disability certificates” p. 34 informs that documents on temporary disability can be obtained by anyone who has family ties with the baby and plans to care for him.

To get a sheet, you need to work and get a white salary. A sick leave certificate for a grandmother who is retired and not working cannot be issued. Another condition is that a woman should take care of the baby constantly, while working at the same time is not allowed.

Rules for registration of sick leave

Disability certificate is issued in the following organizations:

  • a polyclinic in which a minor is undergoing treatment, most often at the place of residence;
  • inpatient unit where the child was lying;
  • private clinic with a permit for medical activity and the issuance of documents.

When you first go to the hospital, a disability certificate is issued, it must be taken at each appointment and closed at discharge. A similar practice is used in the treatment of homes.

The doctor may not write out a certificate of incapacity for work for a person who was not present at the baby’s medical examination. If you need a hospital grandmother to care for a child, then she comes to the reception with a minor.

Failure occurs in the following situations:

  • the patient is more than 15 years old and he is in the hospital;
  • a minor has a chronic disease without exacerbation;
  • the caregiver is currently on vacation;
  • a minor is being treated in a sanatorium;
  • the kid attends kindergarten or school.

A hospital for child care for a working grandmother is issued regardless of the desire of the employer. A working person pays contributions to the Social Insurance Fund, which means that he can receive payment for days that do not work.

The medical institution must issue documents regardless of whether the grandmother lives with her grandson or separately. If the employer, when charging for medical documents, asks for certificates confirming cohabitation, then his actions are considered illegal.

A grandmother living in another city also receives documents from a pediatrician. The issuance of documents is at the discretion of the doctor, who is guided by the interests of the teenager.

If in the family the parents at the time of illness are on regular leave or on maternity leave, and can stay with their son or daughter, then another person has no right to a sick leave.

Terms for issuing medical documents

In order to get a sick leave certificate for a grandmother, you need to familiarize yourself with the rules that guide pediatricians:

  • a child up to 6 years old inclusive - the grandmother will receive a sick leave until the patient is fully recovered;
  • for a teenager from 7 to 15 years old - the caring person may not legally work up to 15 days, a longer period is issued by decision of the medical commission;
  • minor over 15 years - the grandmother will spend 3 days with her grandson, by decision of the VC, they can extend up to 7 days.

Within a year, a woman can leave with her grandson for treatment only for 60 days if the patient is less than 7 years old. The exception is some diseases included in the list of the Ministry of Health and Social Development of the Russian Federation. For them, the period is 90 days.

With a teenager under 15, the total amount of days per year should be less than 45.

The hospital for caring for a sick child with a grandmother is paid with a confirmed quarantine in kindergarten. To do this, you need to get a certificate from the appropriate doctor.

A minor under the age of 15 may stay in a hospital without adults, but in some cases care may be required, and grandmother will be allowed to stay together. If a teenager is sick with HIV, then documents are issued to the caregiver for the entire period of the child’s stay in the hospital.

A sick leave is issued for any period in case of complications in vaccination, with malignant tumors, including diseases of the blood, lymph tissue and related tissues. The sheet must be paid regardless of whether the grandson is being treated at home or in the hospital.

Documents to apply for sick leave

Hospital care for a child's grandmother is paid if all the documents are available.

Grandma takes her passport and medical policy with her. The doctor enters the data on special paper in block letters or in the form of codes. In some clinics, disability sheets are processed electronically.

In the form there is a separate column indicating who the child is the person on whom the paper is drawn up. The law does not require confirmation of family ties. For other relatives, except for parents, code 42 exists.

If two or more children are ill, then information about all children is entered into the hospital grandmother for child care. In the absence of space, a new sick leave is opened.

Accrual of sick leave

The employer will only pay sick leave payments in case of official employment and deductions to the Social Insurance Fund. If a contractual relationship has not been drawn up with the company, then you can not count on payments.

The calculation will depend on the following factors:

  • length of service for a caregiver;
  • average salary for the last two full years;
  • outpatient or inpatient treatment.

When a woman has been working for less than 6 months, her grandmother is paid sick leave to care for her child based on the minimum wage.

From 5 to 10 years - the caregiver can count on 80% of the calculated average for 2 years.

With a total experience of more than 10 years, payment is made in the amount of 100%.

Payment may be refused if the employee was on unpaid leave or the medical regime was violated.

Several children are ill

If two children fall ill in a family, then only one relative, including a grandmother, can sit with them. Grandmother's sick leave will be extended until both grandchildren recover.

If there are more children in the family and they started to hurt one after another, then each child may be given his or her disability certificate and will be closed as soon as it is cured. But payment for a hospital grandmother to care for a child will be made from the first day of the first sick person.

In cases of a protracted illness of several children, relatives alternately take sick leave so as not to lose money when paying.
