Currently, the Administrative Code is in force in Kazakhstan. Its main task is to protect the individual, freedom and rights of citizens, protect the environment, public order, etc. The list of relations that are regulated by the Administrative Code of the Republic of Kazakhstan includes violations of the electoral law, sanitary and epidemiological rules, issues related to business and customs transportation as well as public order. This is relevant not only for Kazakhstan, but also for Russia, for America and for other countries.
As punishment, such means as warning, fine, confiscation,
administrative arrest or compulsory labor are used. In the ordinary everyday sense, the Code of
Administrative Offense regulates various relationships that have no consequences (physical damage or large material losses).
For example, in public places you can’t drink beer, this is a violation of administrative law. It is punishable by a fine. But if, under the influence of a large amount of drunk, a fight starts, someone suffers and ends up in the hospital, then this will not be an administrative, but a criminal offense. So, the Administrative Code of the Republic of Kazakhstan is no longer considered here.
Violation of traffic rules often carries not only administrative, but also civil liability. For example, if someone’s property has been damaged, be it a car or some valuable things.
Crossing railway tracks
in the wrong places means violating the Administrative Code of the Republic of Kazakhstan. In many countries, including Kazakhstan, this is punishable by a warning or a fine. But if, due to this, an accident occurred during which people or property suffered, then this may already be a criminal or civil offense. Other authorities should be connected here.
Administrative violations are considered by officials. For example, customs or tax inspectors, the police, the commission on minors, SES and others. If you do not agree with their decision, then you can go to court. A trial can also be resorted to if the punishment, which should be applied in accordance with the violation, requires the direct decision of the judge, for example in the case of confiscation or administrative arrest. The Administrative Code of the Republic of Kazakhstan cannot solve all the issues that arise. In this regard, there is a need for a document to help resolve emerging situations.
In the Administrative Code of the Russian Federation the last, which entered into force, was amended in 2012 by the Federal Law. It determined the order of ticket sales and related to the games that will take place in Sochi in 2014. At present, the
Administrative Procedure Code of the Russian Federation has not yet been adopted, but there has been a discussion about the need for its creation for a long time. All processes of administrative law (production and enforcement) are regulated by the Administrative, Civil or Arbitration Codes. Unfortunately, they do not always allow finding the right way out of this situation. Therefore, the faster this document comes out, the easier it will be to resolve various disputes.
