Return shoes to the store

No one is safe from buying low-quality or defective shoes. How to return shoes to the store? As a rule, such troubles are resolved at the level of the administration of the trading facility in which it was acquired; in practice, it rarely comes to court.

To return the shoes to the store and get money for it, you must act in accordance with the law. The Law on the Protection of Consumer Rights regulates the procedure for performing the procedure. You must be aware that it is the buyer's responsibility to provide evidence that the product does have a defect caused by the manufacturer.

Even if the shoes were sold without a warranty card, the buyer has the right to demand that he return the full amount or replace with a similar pair of shoes at the same cost. To prove that the purchased shoes had a defect, it is possible with the help of examination. It is carried out at the expense of the seller, provided that the warranty period has not yet expired. Otherwise, the buyer will have to pay for the examination, and you will not be able to return the shoes.

Upon expert confirmation of a defect that arose not through the fault of the buyer, the store must fully compensate for the purchase price. To be sure of the independence of the examination, it is better to conduct it in a special laboratory. However, one must be prepared for the fact that if the assumption of factory marriage is not confirmed, the services of experts will need to be paid on their own, and they are very expensive.

Shoes can often be returned without expertise. If there is a clear defect, you must contact the seller with a statement in duplicate with a request to return the money spent. As a rule, in reputable stores there are specialists who are able to determine the presence of a defect and quickly resolve the conflict. Large stores value their reputation, so itā€™s not profitable for them to leave their customers unhappy;

You should be aware that the return of shoes is associated with the warranty period for it. Decree of the Government of the Russian Federation of 01.19.98 (No. 55) established that the guarantee for shoes purchased out of season begins with its onset. For winter - from November 1, spring - from March 1, summer - from May 1, autumn - from September 1.

Under the law on consumer protection, non-food products (including shoes) of inadequate quality can be exchanged with the seller if he did not fit the consumer in size, shape, style, size, color or configuration. You can exchange it within 14 days from the date of purchase, not counting the day of purchase. Low-quality shoes can be replaced if the product was not in use and retained its original appearance, its properties, factory labels and seals. That is, shoes that do not fit can be exchanged only if you have not worn them.

In order not to return the shoes, but to replace them with another model, you need to make an appropriate allocation based on the amount of the initial purchase and the cost of a new pair, and pay the difference if the new pair is more expensive, or get it from the storeā€™s cash desk if it is cheaper. When returning money for shoes, the store does not have the right to withhold part of the amount for loss of quality that could have occurred while it was with the buyer.

Shoes cannot be returned if they are:

  • worn, has defects formed during operation;
  • has damage (scratches, cuts, etc.), is deformed due to improper wearing or drying;
  • repaired by the buyer before presentation to the store;
  • acquired as discounted.

When returning a shoe that didnā€™t suit you in terms of quality, it must be provided to the seller in its pure form, without any signs of trying on, with all the accessories, packed in a company box.

When returning shoes in which a defect was discovered during operation, it must also be clean and dry, with all components (including broken or damaged parts).
