No one will deny that in recent years a large number of Ukrainian citizens are increasingly arriving in the Russian Federation. There are many reasons for this, and listing them does not make much sense. What are the rules for the stay of Ukrainians in Russia? The answer to this question will be provided later.
Is there a preferential treatment?
Since August 1, 2015, any citizen of Ukraine who has arrived on the territory of the Russian Federation is required to confirm their legal status. He must do it immediately. Otherwise, entry into Russia will simply be prohibited in the future.
Until August 2015, Ukrainians arriving in the Russian Federation could stay in the country for an unlimited time. To start working, they did not need to receive special permits. All this was called a preferential regime. But from now on, the rules for the stay of Ukrainians in Russia have changed significantly. If for whom the indicated benefits have been preserved, then only for residents of eastern Ukraine. And what should the rest of the Ukrainians do?
Russian law establishes that to confirm your legal status you can be guided by the following options:
- registration of citizenship;
- obtaining a temporary residence permit;
- obtaining permission to issue a residence permit;
- registration of a working patent (using an employment contract with a Russian organization).
Innovations
What norms have the Russian authorities adopted, in particular the Main Directorate for Migration (former FMS)? The new rules for the stay of Ukrainians in Russia can be found on the official website of the Russian Migration Service. A brief description of them will be provided below.
From now on, every Ukrainian who comes to Russia is required to fill out a migration card. This is a special document with a unique number that contains information about a foreigner, and also indicates the purpose of his stay in the country. If we are talking about refugees, then receiving such a card is not necessary. It will be enough to apply for a special application in the following paragraphs:
- at customs at a checkpoint during border crossing;
- in the Russian representative office in Ukraine;
- in Russia itself, in the nearest department of the migration service.
The order of stay of Ukrainian citizens in Russia implies:
- stay no more than 90 days; otherwise, the period must be extended by confirming the legality of your stay in Russia;
- imposition of a fine on a citizen who has exceeded the term of stay in the country by even one day;
- in the case of valid reasons (such as study, illness, work, etc.), small indulgences may be granted.
The new rules for the stay of Ukrainians in Russia also imply the payment of a state duty: 1600 rubles for a temporary stay and 3500 rubles for a residence permit.
About the migration card
As mentioned above, the rules for the stay of Ukrainians in Russia require a special migration card. This document is worth a little more detail.
You can get the form already at the border. Customs officers can offer the card to aircraft crew, train crews, or bus drivers. If a person travels to Russia on his vehicle, then you can make a corresponding request with a border guard officer.
No difficulties with filling out the card should arise. Passport data are entered in the form, and the true purpose of the visit is indicated (by the way, for identifying violations, Ukrainians can be expelled from the country without the possibility of return). Estimated length of stay in the country should be indicated. You can extend your stay by presenting a migration card to the nearest migration department.
About employment
Separate requirements are put forward for the order of Ukrainian citizens to work in Russia. The first step should be an indication of the purpose of the visit. So, in the migration card in the corresponding line should indicate the word "work". This is the basic requirement for a labor patent. The fixed rules for the stay of Ukrainians in Russia establish the validity of a working patent - at least 1 month and not more than 1 year. Naturally, a patent can be prolonged (extended).
The second stage is the passing of exams in the Russian language and the history of Russia. It will be simply impossible to get a job in Russia without a certificate confirming the successful passing of exams.
Documentation for employment in Russia
What documents does the Russian Federal Migration Service call the documents necessary for applying for a job ? The rules for the stay of Ukrainians in Russia are fixed by law, and therefore binding.
According to the law, citizens of Ukraine who want to officially work in the territory of the Russian Federation are required to purchase and execute the following documents:
- Voluntary health insurance policy. The executed document must be kept by the Ukrainian throughout his stay in Russia.
- Certificate of payment for a patent. This is a special document that allows legalizing the work activities of a citizen of Ukraine in Russia. The maximum patent term is 12 months.
- SNILS, according to which a citizen of Ukraine, oddly enough, will deduct part of the salary to the Russian Pension Fund.
- The employment contract itself. In order for the patent not to be revoked, the Ukrainian is obliged to submit a copy of the employment contract to the FMS.
Thus, the rules for the stay of Ukrainians in Russia, as well as the implementation of work activities in the country are strictly regulated by law.
New rules for residents of Donbass
In 2015, Russia developed new rules for the stay of Ukrainians in Russia. Among them are the rules on the resettlement of residents of Donbass, for which some benefits should have been assigned initially. Most of the norms, contrary to popular belief, do not comply with the Federal Law "On Internally Displaced Persons".
So, residents of Donbass are not able to cross the Russian border in a simplified manner. Here, everything is the same as with all other Ukrainians: the classic residence permit, the duration of stay is not more than 90 days. Of course, this period can be extended by contacting the local migration authority.
