The certificate of a judge, in accordance with the law of the Russian Federation, is issued to judges of instances of all jurisdictions on the basis of their appointment to the corresponding position. A document can be used by its owner as an identity card, and for representatives of state power it is also a guarantee of the immunity determined by law. This means that a court employee who possesses such a document cannot be prosecuted, arrested or prosecuted without a special decision.
The procedure for obtaining a judge’s certificate
The procedure for obtaining a document ensures that no later than a month after the appointment of an employee to the appropriate position, the documents drawn up are sent for signature to the President of the Russian Federation. Within 10 days, but not later, they are returned for delivery. The identity of the judge is transmitted to the owner in the presence of colleagues in a festive atmosphere.
It is important to note that when the judge resigns, the identification documents remain in his possession. Upon termination of authority for other reasons, the document must be transferred to the chairman of the relevant judicial board.
List of required documents
Since the judge’s certificate is issued only to the persons appointed to the position, the list of documents necessary for receiving it coincides with the required papers for the appointment:
- identity document of a citizen of the Russian Federation ;
- profile with biographical data;
- documents on higher education;
- a work book confirming the existence of the necessary work experience;
- copies of tax registration of the job applicant and members of his family;
- established medical certificate;
- certificate from a drug dispensary;
- certificate from a neuropsychiatric dispensary ;
- certificate with marks on passing the qualification exam ;
- job characteristics over the past five years;
- job applicant income data
- income statements of the spouse;
- help-lens;
- 3x4 photo (three pieces);
- receipts of the corresponding sample.
Certificate of Justice of the Peace
A roughly similar list of documents is also necessary for the appointment to the position of justice of the peace (with a few exceptions). So, the applicant for the position of federal (magistrate) judge must submit a document attesting to state accreditation.
In addition, you will have to provide a copy of the certificate of marriage or divorce, and after a positive decision by the qualification commission of judges, you must write a statement addressed to the President of the Russian Federation.
Assistant Judges
Assistant judges are appointed on the basis of competition rules established by each agency. Accordingly, the list of documents for obtaining a certificate of an assistant judge is determined by each court individually. The main requirements for applicants are set out in the law of the Russian Federation “On increasing the number of apparatus of the judiciary”.
As a rule, people who have a higher legal education and at least three years of experience are employed. Therefore, the first step on the way to the post of assistant is usually the post of court clerk. After this, the future judge opens the gates to the assistants, and only then the post of judge. An interesting fact is that some judges have several assistants subordinate.
Arbitration court
The arbitration or commercial court is not a public authority, and therefore the relevant documents of its employees do not provide the human rights guarantees that representatives of other courts have.
As a rule, in order to obtain a certificate of an arbitrator, you just need to conclude an agreement with the relevant court and submit documents proving the identity of the citizen. After the order of the chairman of the court on the appointment to the post, such a certificate may be issued into the hands of the applicant.
Despite the fact that the document does not provide equal rights with state judges, it can be used as an identity card, and experience in the arbitration court can be an additional bonus in the resume when applying for a job in the legal profession.
The procedure for recovering documents in case of loss or its replacement
If you lose or need to replace the appropriate certificate (for example, when changing the name), you must attach documents confirming the need for this. The latter may be papers that certify the theft or change of surname, which is accompanied by an application for the issuance of a duplicate or a new document.
Within five days from the receipt of the relevant petition, the chairman of the court is obliged to transfer the application and the attached documents to the Office of the President of the Russian Federation for Civil Service and Human Resources. There, no later than one month after receipt of the papers, a duplicate or a new certificate is made, which, after the signature of the head of state, is sent to the employee’s place of work. Repeated presentation of certificates to judges follows the same rules as the first time: documents are issued in a festive atmosphere in the presence of colleagues.
It is important to note that the costs of replacing the certificate are borne by the judge himself. Only if the document is replaced for reasons beyond the control of the judicial officer (for example, due to theft), the administration of the head of state will cover the costs.
