Duration of Vacation Depending on its Type and Features of the Conditions of Labor

Annual paid leave is one of the state social guarantees provided to working citizens. Chapter 19 of the Labor Code of the Russian Federation establishes the following types of leave: the main annual paid (or labor); additional rest , as well as leave without pay (at their own expense). Other types of recreation are established by employers or parties to the collective agreement.

The duration of annual leave is now 4 weeks (28 calendar days). Employees who have entered into an agreement for a period of up to two months, the main vacation (or compensation for it) is provided at the rate of two working days for the worked month. For seasonal workers, the main holidays are two calendar days for the month worked.

Additional paid rest is regulated by government decisions or local acts of enterprises. Extra rest for employees with irregular working hours may be at least three calendar days long.

Leave without salary, the need for which is connected with family circumstances or other good reasons, is granted at the request of the employee. The duration of the vacation is negotiated by him with the employer and is appointed by mutual agreement.

At the same time, WWI participants are entitled to 35 calendar days of unpaid rest, working pensioners - 14 days, working disabled people - up to 60 days, immediate relatives of servicemen who died in the line of duty - up to 14 days, employees who become parents, register a marriage or have lost a relative - up to 5 days.

The duration of the vacation, which includes the main and additional, maximum limits is not limited. Their duration is set by organizations depending on their own financial and production capabilities.

The basic principles governing the procedure for granting and duration of paid leave are prescribed in articles 114-128 of the Labor Code of the Russian Federation. The right to receive an annual vacation with an employee appears after six months of work at a certain place. By agreement with employers, this period may come earlier.

The duration of the leave is indicated in the Labor Code. Paid vacation is calculated annually in calendar days and cannot be less than 28 days. Some categories of workers (for difficult or harmful working conditions) have the right to receive additional leave, which is provided in addition to the main one. Thus, in total, they should rest for more than 28 days.

The duration of paid vacation does not include holidays falling out for this period, and the last day of vacation, therefore, is shifted by the number of days that the holidays took in it.

Under the law, underage workers have a guaranteed right to 31 calendar days off.

Pedagogical workers of universities go on an extended vacation in the amount of 56 days. Other categories of pedagogical staff receive leave of 42 to 56 days.

The longer duration is characterized by holidays of disabled people, government employees, municipal employees. They are provided with rest for at least 30 calendar days.

Employees of the prosecutor's office, including investigators, prosecutors, pedagogical and scientific employees of the prosecution system, are entitled to 30 calendar days to rest, which does not include travel time to the place of rest.

The duration of the leave of specialists of healthcare organizations is 36 working days, taking into account additional rest for harmful working conditions. This category includes workers who diagnose and treat HIV-infected people, as well as work with materials that contain the immunodeficiency virus.

Scientific organizations that receive budget funding have the right to independently determine the duration of paid rest for certain categories of scientific employees with an academic degree: doctor of sciences - 48 working days, candidate of science - 36 working days.

Categories of workers engaged in the handling of chemical weapons are entitled to 49 or 56 calendar days of annual rest, depending on the degree of importance of the work performed.
