Creating an emergency on the road: fine, articles of the Administrative Code of the Russian Federation

For the creation of an emergency on the road, a fine is inevitable if the violation is noticed by the traffic police. The rules for driving on roads were created from adverse practices collected from traffic accidents. The Ministry of Internal Affairs did not develop requirements in order to set a fine for creating an emergency on the road. They sought to prevent dangerous violations.

Driver driving

Terminology features

With the increase in the well-being of the people, the problem of traffic jams on the roadway in the cities appeared. The accumulation of cars requires special care and driving culture from drivers. The press began to publicly discuss the issue of dangers on the highway. Law enforcement agencies, road associations are studying the tight control of vehicles. In 2016, for the first time in traffic rules, the concept of dangerous driving appeared. Moreover, the instructors paid great attention to this issue in training. In the examination tickets, the creation of an emergency on the road was played in pictures. They didn’t forget about the fine either.

Future drivers are required to understand the arrangement of the vehicle and properly steer. Such measures are necessary to reduce indicators with trauma, death, where there are many affected children. Lawmakers believe that for creating an emergency on the road, a fine is too loyal a measure that should be tightened. Perhaps the threat of punishment, deprivation of a driver’s license and other preventive measures will slightly reduce extreme maneuvers.

Aggressive Way of Management

It is considered a criminal behavior to regularly violate driving rules and create an emergency on the road. Article 12.38 of the Administrative Code of the Russian Federation confirms this. It should be understood that the legislative act is not about a single neglect of the requirements of traffic rules, but systematic. The inspectors made an analysis that allowed us to classify really dangerous maneuvers, which included the following points:

  • abrupt stop without keeping distance;
  • reconstruction at one’s own discretion;
  • overtaking cars without counting on approaching oncoming traffic;
  • drive close to the car while driving;
  • game for overtaking in a dense stream of vehicles;
  • non-observance of lateral distances;
  • lack of concessions to priority transport - ambulance, firefighters;
  • increased speed within the city, village, any village;
  • neglect of pedestrian crossings.

Errors or pattern?

Each driver knows his driving practices, which can significantly extend the list. Many of them are not considered errors - this is dangerous driving. Such behavior entails natural consequences:

  • injuries
  • death;
  • wrecked cars.

Statistics indicate that mortality in accidents is increasing. To date, it has already exceeded deaths from accidents and serious diseases.

Extreme driving

Case studies

What did legislators have in mind when they introduced the term “creating an emergency on the road” in the Code of Administrative Offenses? Tighter rules will benefit drivers who do not violate traffic rules. The punishment of the drivers who caused the accident, but they themselves were not injured, but tried to hide, is justified. The situations are clear to those who drive:

  1. Cunning man suddenly cuts the car, she tries to dodge him by leaving for the oncoming lane, and immediately there is a blow. It would seem that the offender is alone, the one who was not on his side. And the real culprit is far away at this moment.
  2. The taxi driver concentrated all his attention on the voting passengers, what happened next - he missed. They try to dodge it, changing lanes, an entry occurs in the side panel of the car, which did not expect dangerous permutations and sudden maneuvers.
  3. Tired of waiting for the green light in front of the traffic light, I decided to save time and quickly slip through, not noticing that not all vehicles passed from the intersection. The driver, in front of whom the car rushes, presses the brake and receives a blow from the car following it.

All of these examples are considered commonplace in the daily sequence of incidents. Such situations are “resolved” by road inspectors. They understand why penalties have been tightened. The main thing is that they really benefit the residents, drivers, pedestrians, and not the controllers themselves.

Police investigation

Who is given the right to blame?

To avoid misunderstandings, laws should be regularly checked for updates; changes often appear in them. The fault of a motorist or a professional can only be recognized by state traffic inspectors. If they were not at the scene, the evidence is:

  • witness's testimonies;
  • DVRs
  • recordings from the phone.

For one violation, a fine is not supposed, the concept of aggressive driving implies a regular repetition of violations. If there is evidence, the penalty is 5,000 rubles. If the driver does not keep the distance while driving, at stops in front of the traffic light, he can be punished for 1,500 rubles. A significant 50% discount is provided for significant fines, provided that the offender does not delay the payment, but contributes money to the state treasury within one month.

Incident investigation

What leads to accidents on the road?

The driver is not always guilty of traffic violations. During training courses, teachers explain in detail how to monitor the condition of the car, because any malfunction can lead to big trouble. Usually investigating an incident, when sentencing refers to article 12.12 of the Code of Administrative Offenses. It reveals violations during maneuvering.

Emergency situation

Dangerous situations

There are many misconducts that become provocative for other participants in the movement:

  • there are no signals warning of turns, turns, lanes;
  • unexpected maneuvers for other drivers;
  • turns, turns, overtaking by rear movement in prohibited places;
  • no concession to the lane of cars when they are going to overtake;
  • speeding on a slippery, icy track, sharp turn — as a result of such manipulations, the car can simply be brought into the oncoming lane;
  • you need to strictly monitor the interval not only in front of the going cars, but also the side ones;
  • sudden braking for no reason can lead to an inadequate solution for other drivers.

Drivers should not give spatial advice on caution and care. While driving, even absolutely neat motorists with properly functioning mechanisms can do anything. Therefore, jurists are trying to legislatively resolve every unforeseen case.

List of penalties

The administrative code also contributed to the legislation governing the culture of road traffic - this is Art. 12 15 Administrative Code of the Russian Federation. This act gives a detailed indication of what misconduct should be fined and in what amounts. For example, you can’t throw your car on the road when driving oncoming. It is unacceptable to drive along the side of the road, as well as where there is a marking on the intersection of transport and foot columns. For such violations face a fine of 1,500 rubles. Equal sanction is granted to drivers of low-speed vehicles who do not want to pass cars on the highway. It is forbidden to move along paths that are intended for cyclists and pedestrians - for misconduct they will be punished for 2,000 rubles. If administrative offenses are regularly repeated, and special technical means confirm this, you can not only “earn” a fine, but also lose your driver’s license for a year.
