Three branches of government

Three branches of state power have long been distinguished . Why is this separation necessary? The bottom line is that too much authority should not be in the hands of people alone. As an example, one body should not create laws by which it will subsequently affect people's behavior.

Branches of power: types, essence, difference, influence on each other

Legislative power in almost all civilized countries is considered people's power. How to understand this? It is believed that the only source of power is the people. Why, then, are new people accepted by specific people and bodies? It's all about the representation. It is believed that people choose those whom they trust to create new laws.

Yes, the legislative branch is strong because it has the exclusive right to pass laws. Laws adopted in parliament may not be approved by the executive branch, but the legislative branch may also have a certain impact on the executive branch. Everything here is based on the so-called system of “checks and balances”, thanks to which the branches of power are always in equal position and in no way can influence each other's decisions.

Legislative power is an independent power. Bills should not be developed taking into account the interests of specific individuals, but specifically taking into account the interests of all people living in the country.

The executive branch, of course, is not connected with the development of bills. Its bodies are directly involved in government. Its highest organ is the Government. What does the President of our country have to do with the executive branch? This question is not so simple. The fact is that the Constitution does not classify it as a specific branch of government, but according to the logic of things, it nevertheless gets executive power. The government is directly governed by the Prime Minister (Russia is a presidential-parliamentary republic). The President of the Russian Federation has influence on the Government, but nothing concrete can be said about the degree of this influence. Many famous lawyers have long been debating about this.

The executive branch of government acts on the basis of laws adopted by parliament, local governments, and so on. We can say that it implements these laws. It also ensures their execution.

This branch of government operates throughout the country, and its action is continuous. Yes, it is independent, but the actions of people endowed with executive and administrative powers should not go beyond the framework of adopted laws. Illegal actions are not permissible under any circumstances.

Three branches of government. What is the third? Trial. Many well-known lawyers consider her the most independent. It is designed to protect the right and act as an arbitrator in disputes that arise over it.

Judicial power is in the hands of judges, that is, those people who, relying on the law, must administer justice. Judges are inviolable, independent, irremovable, appointed, however, in their decisions on specific cases, they can only rely on current legislation. Any attempts to somehow influence judicial decisions are brutally suppressed. Crimes against judges are considered very serious.

The separation of powers has existed in the world for quite some time. What can be said about our country? First of all, it is worth noting that the Soviet authorities did not recognize the three branches of government and believed that everything should be concentrated in one hand. They considered the separation of powers a bad idea that could only be born in the minds of bourgeois thinkers of other countries. The USSR collapsed - three independent branches of power appeared.
