Extortion (the article will be devoted specifically to this topic) is a requirement from a person or organization to take certain actions under the threat of physical impact on them, liquidation of property or the dissemination of untruthful information that could harm the person to whom this requirement is presented. In many states this is a criminal offense, but each country has its own levels of criminal prosecution and its own formulation of an act of antisocial behavior.
Considering the Russian criminal legislation, it should be noted that extortion (article 163 of the Criminal Code of the Russian Federation) is punishable by restricting a person’s freedom for a maximum of four years (in this case, a fine may be issued in the amount of a prisoner's salary) or by forced labor also for up to four years ( freedom may be limited for up to two years), or arrest for up to six months.
The article for extortion also provides for restriction of liberty for up to seven years, and a fine is payable in the amount of a person’s wages for the last three years if the criminal act was committed by a group of people who had previously conspired with each other, as well as if there was violence or large-scale extortion.
The punishment for a crime of imprisonment of up to fifteen years, and a fine of a prisoner’s salary for the last five years is levied, is applied in the case of extortion in order to obtain large-scale material assets or when serious damage was caused to the health of a person whose rights were violated .
It should also be pointed out here that extortion (article 156 of the Criminal Code of the Russian Federation) of unlawful remuneration constitutes a deliberate placement of a person in conditions under which he must transfer unlawful remuneration in order to prevent negative consequences.
It should be noted that in order to individualize criminal acts during extortion, it is necessary to pay attention to two details: the demand, which is accompanied by threats, as well as the transfer of material assets and the execution of the demands of fraudsters. For example, if property is received in the future, it can be argued that there is extortion (an article for which provides for imprisonment of up to four years), and if the fulfillment of requirements must be carried out immediately, it is necessary to talk about robbery or robbery.
Thus, the correct formula for determining extortion is built. It consists in the fact that there must be a demand and its immediate execution in the event of a threat in the future, while the victim obeys any instructions of the offender, or the demand in case of a threat and an order to fulfill it in the future.
Summing up, it must be said that there is an article in the Criminal Code of the Russian Federation (extortion and punishment for it) that fully discloses the issue regarding this criminal act and providing for sanctions for it. It should always be remembered that any crime does not remain unpunished.
